SMS Opt-In and Opt-Out

This page describes how Phygitals collects consent for SMS messaging, how users can opt in and opt out, and how we maintain compliance records required for SMS registration and delivery through Customer.io.

Overview

Phygitals sends SMS messages only to users who separately and affirmatively opt in to receive text messages. Adding a phone number for login authentication (via Privy) or for shipping a physical card redemption does not automatically enroll you in marketing SMS.

Where Users Opt In

Users may opt in to Phygitals SMS alerts through:

  1. Onboarding — Add Phone step: During account onboarding, users may choose to add a mobile number to receive pack drop alerts. Opt-in requires affirmative action and displays the consent disclosure below.

  2. Account Settings: Users with an existing account may enable SMS alerts from their profile or notification settings, where available.

  3. Future collection points: Any web form, checkout flow, or landing page that collects SMS consent will display the required disclosure and link to our Privacy Policy and SMS Messaging Terms.

Users may skip SMS opt-in during onboarding ("Maybe later") without affecting account creation or platform access.

At each SMS opt-in point, Phygitals presents language substantially equivalent to the following:

By providing your phone number and opting in to SMS alerts, you agree to receive recurring automated promotional and personalized marketing text messages (e.g., pack drop alerts) from Phygitals at the mobile number provided. Consent is not a condition of purchase. Reply HELP for help and STOP to cancel. Msg frequency varies. Msg & data rates may apply. View our Terms of Service, Privacy Policy, and SMS Messaging Terms.

Where a checkbox is used, it is unchecked by default and must be actively selected to opt in.

What We Record

When a user opts in, Phygitals records:

When a user opts out, we record:

These attributes are stored in Customer.io and honored by our messaging segments. Opt-out status takes precedence over any prior opt-in and must not be overwritten by stale data imports.

Opt-Out Methods

Users may opt out of marketing SMS at any time by:

  1. Replying STOP (or CANCEL, END, QUIT, UNSUBSCRIBE, OPT-OUT, REVOKE) to any Phygitals SMS message;

  2. Replying HELP for assistance;

  3. Emailing legal@phygitals.com with the subject line "SMS Opt-Out"; or

  4. Disabling SMS alerts in account settings, where available.

Opt-out requests are processed immediately. We send a one-time confirmation message and add the phone number to our suppression list.

Message Types After Opt-Out

After opting out of marketing SMS, users will not receive promotional or marketing text messages. We may still send transactional messages strictly necessary to complete a specific request the user initiated (for example, a shipping update for an in-progress physical card claim).

Audience Segmentation

Marketing SMS campaigns in Customer.io are sent only to profiles that meet all of the following:

  • sms_consent is true

  • sms_opt_out is not true

  • phone is present and stored in E.164 format

  • User meets eligibility requirements in our SMS Messaging Terms

Record Retention

Phygitals retains SMS opt-in records, message content, delivery receipts, and opt-out records for a minimum of four (4) years after the last message is sent to a user, or as required by applicable law and carrier audit requirements.
