Markdown versions of documentation pages are available by appending `.md` to page URLs; this page is available as [Markdown](https://docs.phygitals.com/user-agreements/sms-messaging-terms.md). # SMS Messaging Terms ## SMS Messaging Terms **Last Updated:** July 8, 2026 These SMS Messaging Terms ("**SMS Terms**") supplement the Phygitals [Terms of Service](https://docs.phygitals.com/user-agreements/terms-of-service) and [Privacy Policy](https://docs.phygitals.com/user-agreements/privacy-policy). By opting in to receive text messages from Phygitals, Inc. ("**Phygitals**," "**we**," "**us**," or "**our**"), you agree to these SMS Terms. ### 1. Program Overview Phygitals offers an optional SMS and MMS text messaging program. When you separately and affirmatively opt in, we may send recurring automated text messages to the mobile phone number you provide. **Types of messages you may receive include:** * **Marketing and promotional messages:** pack drop alerts, marketplace notifications, special offers, cart reminders, and personalized recommendations based on your interests; * **Transactional and informational messages:** account security alerts, purchase confirmations, shipping and claim updates, and service-related notifications tied to activity on the platform. Providing your phone number for account login or shipping purposes does **not** enroll you in marketing SMS. Marketing SMS requires a separate opt-in. ### 2. Consent By opting in to Phygitals SMS alerts, you authorize Phygitals to send recurring automated promotional and personalized marketing text messages (e.g., pack drop alerts) and non-marketing informational messages to the mobile number you provide, including through an automatic telephone dialing system, where permitted by law. **Your consent confirms that you understand:** 1. You are authorizing Phygitals to send SMS messages using an automatic telephone dialing system; 2. You may receive marketing, transactional, and informational messages as described above; 3. Message frequency varies based on your activity and preferences; you may receive up to **ten (10) marketing messages per month**, and no more than **one (1) marketing message per day**; 4. **Message and data rates may apply** depending on your mobile carrier plan; 5. **Consent is not required** as a condition of purchasing any goods or services or using the Phygitals platform; and 6. You may opt out at any time as described in Section 4. We do not accept consent obtained by third parties unless that consent specifically identified Phygitals by name as a sender and meets applicable legal requirements. ### 3. Message Frequency and Timing Message frequency varies. Marketing message volume depends on platform activity, your preferences, and campaigns you are eligible for. We aim to limit marketing messages to no more than: * One (1) marketing message per day; * Four (4) marketing messages per week; and * Ten (10) marketing messages per month. We will not send more than three (3) SMS messages about the same subject within a 24-hour period. Marketing SMS messages are sent between **8:00 AM and 9:00 PM** in the recipient's local time zone, or stricter hours where required by state law (including 8:00 AM to 8:00 PM in Florida, Oklahoma, and Washington). ### 4. Opt-Out Instructions You can stop marketing SMS messages at any time: * **Reply STOP** to any Phygitals text message to unsubscribe from marketing SMS; * Reply **HELP** for help or contact ****; * Manage preferences in your Phygitals account settings, where available. We also honor these opt-out keywords: **STOP, CANCEL, END, QUIT, UNSUBSCRIBE, OPT-OUT,** and **REVOKE**. After you opt out, we will send a **one-time confirmation** that you have been unsubscribed. Opt-out requests are processed **immediately** and at **no charge**. We maintain a suppression list to ensure opted-out numbers do not receive further marketing messages. Transactional messages necessary to complete a request or transaction you initiated (such as a one-time shipping update for an active claim) may still be sent even after you opt out of marketing messages. ### 5. Help and Support For help with SMS messages: * Reply **HELP** to any message; or * Email **** with the subject line "SMS Help"; or * Contact general support at [phygitals.com/contact](https://www.phygitals.com/contact). ### 6. Carrier Disclaimer **Message and data rates may apply.** Delivery speed and availability depend on your mobile carrier and network conditions. **Carriers are not liable for delayed or undelivered messages.** MMS (picture) messages, where offered, are limited to the United States and Canada and depend on carrier support. ### 7. Eligibility To opt in to Phygitals SMS messages, you must: * Be at least **eighteen (18) years of age** (or the age of majority in your jurisdiction); * Provide a valid mobile phone number that you own or control; * Be located in a jurisdiction where receipt of such messages is lawful; and * Not have previously opted out of Phygitals SMS messages from that number. ### 8. Phone Number Format and Accuracy You agree to provide an accurate mobile phone number. We store phone numbers in **E.164 format** (e.g., `+14155552671`). You are responsible for keeping your phone number current in your account settings. ### 9. Privacy Our collection, use, and sharing of phone numbers and SMS-related data is described in our [Privacy Policy](https://docs.phygitals.com/user-agreements/privacy-policy). We use **Customer.io** and **Twilio** to deliver SMS messages on our behalf. We do not sell your phone number or share it with third parties for their own marketing purposes. ### 10. Changes We may update these SMS Terms from time to time. Material changes will be reflected by updating the "Last Updated" date and, where appropriate, providing notice through the Service. Your continued receipt of SMS messages after changes become effective constitutes acceptance of the updated SMS Terms unless you opt out. ### 11.
