# Referral Programme Guidelines ## Referral Program Rules \ Thank you for contributing to the growth of our community. From time to time, Phygitals may invite you to participate in one of our referral programs to help introduce others to the Phygitals platform. By participating in a referral program—whether by referring friends or family, or by signing up using a referral link or code—you can earn exclusive rewards, discounts, or other incentives (each a "Referral Reward"). These Phygitals Referral Program Rules ("Rules") apply to referral programs managed solely by Phygitals. By sharing your referral link or code, or by signing up using a referral link or code, you agree to abide by these Rules. Any breach of these Rules may lead to disqualification from the referral program, forfeiture of any earned Phygitals credits, rewards, or money, and potentially the deactivation of your account. Additionally, specific terms may apply to your Referral Reward based on the region where you signed up, including required actions and the type and amount of the Referral Reward. Please refer to the additional terms provided with your invitation, or the details available in our app or on our website when you make your referral. These Rules are supplemental to the [Terms of Service](/logistics-and-legal/user-agreements/terms-of-service.md) governing your use of the Phygitals platform, which may be updated periodically. ## Who Can Be a Referrer/Inviter? Anyone can be a referrer/inviter if they (a) are a legal resident of their country, (b) are of legal age according to the laws of their region, and (c) have a Phygitals account in good standing. Referrers/inviters can be any type of Phygitals user, but they are limited to one account on the Phygitals platform. ## Who Can Be a Referee/Invitee? Your friends, family, and others you know (but not yourself) may be eligible to be referees/invitees. To determine eligibility, keep in mind the following stipulations: **Eligible referees/invitees for those who order services through the Phygitals platform:** To receive a Referral Reward for referring someone through the Phygitals platform, your referee/invitee must (a) be a new Phygitals user, (b) meet the conditions Phygitals has set for using the platform, and (c) complete the actions required by the specific referral program. **Eligible referees/invitees for those who use the Phygitals platform:** To receive a Referral Reward for referring someone who makes a qualifying purchase through the Phygitals platform, your referee/invitee must meet the eligibility criteria noted in the referral invite or offer. Your referees/invitees can be referred/invited only once, so if someone else has referred them and they have accepted that invitation, they will not be able to accept yours. If you are providing Phygitals with the contact information for your referees/invitees, you represent that you have the right to provide that information. ## How Can I Use My Referral Link or Code? Phygitals reserves the right to limit the number of times you may use or share your referral link or code based on the referral program in which you participate. To see if your link or code has a limit, refer to the terms of the specific referral program in which you are participating. Phygitals encourages you to share your referral link or code and earn Referral Rewards, but these links or codes must be used only for personal and non-commercial purposes. This means you should share your referral link or code only with people you know. You agree that you will not: * Attempt to gain referees/invitees by spamming, bulk emailing, or sending large numbers of unsolicited emails. The only people you should be emailing are those you know personally or who have signed up to receive communications from you. * Use, display, or manipulate Phygitals’ intellectual property (such as logos, trademarks, and copyright-protected works) in any way, except to identify yourself as a Phygitals user or referrer. * Create or register any (i) businesses, (ii) URLs, (iii) domain names, (iv) software application names or titles, or (v) social media handles or profiles that include the word "Phygitals" or any of Phygitals’ trademarks or any words that are confusingly similar. * Use Phygitals’ trademarks as your social media profile picture or wallpaper, or use any of Phygitals’ copyright-protected works (such as graphics, photos, images, drawings, and screenshots from Phygitals’ website or app) without Phygitals’ express written permission. * Purchase keywords (including, but not limited to, Google AdWords) that contain any of Phygitals’ trademarks. * Use automated systems or bots through any channel to distribute, post, or otherwise share your referral link or code. * Use scripts or programmed or automatic dialers to send invites or otherwise share your referral link or code. * Make misleading claims about Phygitals, use offensive or abusive content, create fake websites/webpages/social media profiles/apps, misrepresent your connection to Phygitals, or otherwise make any false or misleading statements to get a referee/invitee to use your link or code. * Use your referral link or code in any manner that violates the law or the rights of anyone else. When you share your referral link or code, please explain that you are a Phygitals referrer. ## How Do I Earn My Referral Reward as a Referrer/Inviter? As long as you and your referee/invitee follow these Rules, the Terms of Service governing your use of Phygitals’ platform, the Specific Rewards Terms, and you have an activated account to receive the payout, you should receive your Referral Reward after your referee/invitee uses your link or code to sign up with Phygitals, activates the referral offer, and completes the requirements for the particular Referral Reward. Referral Rewards are discretionary, and the amount and requirements to receive them can vary. Phygitals reserves the right to set a limit on the number of times you may use your referral link or code. The requirements for receiving, and the amounts of, Referral Rewards are subject to change at Phygitals’ sole discretion. Referral Rewards in the form of Phygitals credits are not transferable, have no cash value, and may expire. ## How Can I Earn a Referral Reward as a Referee/Invitee? Referees/invitees may receive a discount or specific buyback offer the first time they use and purchase a qualifying item on the Phygitals platform. The amount and form of the discount or buyback offer will be shown to the user prior to purchase. The referee/invitee needs to have an activated account to receive the referral reward. ## Termination and Changes Phygitals reserves the right to change, end, or pause, in whole or in part, any referral program, as well as any referrer/inviter's or referee/invitee's ability to participate in any referral program or receive Referral Rewards at any time for any reason, including suspected fraud, abuse, or any violation of these Rules as well as any agreement (if one exists) between you and Phygitals or any of its subsidiaries and affiliates. In accordance with applicable laws, if Phygitals ends any referral program, any unused or unredeemed Referral Rewards may be forfeited at that time, provided we give you 14 days’ notice to use or redeem your Referral Rewards. Phygitals may update these Rules at any time. If Phygitals makes an update, we will post the update on the Phygitals website and provide you with notice of the update. Continued participation in any referral program after any update will mean that you have agreed to the update. Got questions?
